The US Supreme Court will hear oral arguments in early November 2025 following the Court of Appeals’ upholding of a 28 May ruling that the Trump Administration exceeded its authority to impose broad tariffs under the International Emergency Economic Powers Act of 1977 (IEEPA).
The US Supreme Court granted a motion on 9 September 2025 to fast-track review of a petition for a writ of certiorari concerning the Trump Administration’s authority to impose broad tariffs under the International Emergency Economic Powers Act of 1977 (IEEPA).
This follows a decision by the US Court of Appeals that upheld the 28 May 2025 ruling of the US Court of International Trade, which had found the Administration exceeded its authority. Oral arguments are scheduled for the first week of November 2025.
The Court has consolidated Case No. 24-1287 and Case No. 25-250 for briefing and argument, meaning all future filings and activity will be reflected under Case No. 24-1287.
Earlier, US President Donald Trump announced that his administration would seek an expedited Supreme Court ruling on tariffs deemed illegal by a US Appeals Court.
This follows after the US Appeals Court ruled, on 29 August 2025, that most of the tariffs imposed by the Trump administration are illegal, but allowed them to remain in place until 14 October to give the administration time to appeal to the Supreme Court.

The motion to expedite and the petition for a writ of certiorari are GRANTED. The petition for a writ of certiorari before judgment in No. 24-1287 is granted. The cases are consolidated, and a total of one hour is allotted for oral argument. Respondents in No. 24-1287 and petitioners in No. 25-250 shall file an opening brief on the merits on or before Friday, September 19, 2025. Any amicus curiae briefs in support or in support of neither party shall be filed on or before Tuesday, September 23, 2025. Petitioners in No. 24-1287 and respondents in No. 25-250 shall file response briefs on the merits on or before Monday, October 20, 2025. Any amicus curiae briefs in support shall be filed on or before Friday, October 24, 2025. A reply brief shall be filed by Thursday, October 30, 2025.
