On 31 January 2024, Spain published the Royal Decree 117/2024 in the Official State Gazette in which it outlined the implementation of the due diligence procedures and regulations for the compulsory automatic exchange of information among digital platform operators as per the European Directive 2021/514 (DAC7). The DAC7 directive mandates an immediate reporting of information requirements for digital platform operators and sets rules for exchanging information among European Union Member States.

The new regulations are designed to set out due diligence procedures and rules for digital platforms when reporting information about the sellers they host by the DAC 7 directive. The Decree also finalizes the regulation of registration and reporting obligations for digital platforms.

On 5 February 2024, the HAC/72/2024 was published in the Official State Gazette, which authorized the registration and return forms (Form 040 and Form 238) for digital platform operators to report information.

Under the new Decree, digital platform operators in Spain must submit their initial informative return under DAC7 within 8 April 2024.
