On 5 February 2020, the Peruvian Tax Administration (SUNAT) has published first version of the list of high-risk tax planning schemes regarding General Anti-Avoidance Rule (GAAR). The list contains the following five tax planning schemes:

  • Deduction of royalties for assignment in use of the brand,
  • Disposal of a Peruvian company through autonomous equity,
  • Sale of shares and change of address to a country with an agreement to avoid double taxation,
  • Transfer of trademarks and capitalization of credits, and
  • Management contract.

The list will be periodically updated, aims to discourage the use of elusive schemes and motivate voluntary compliance with tax regulations.
