On 10 May 2020, the Peruvian Tax Administration (SUNAT) has issued Legislative Decree No. 1487, through which the tax payment deferral regime is established in response to COVID-19. the deferral regime of the tax debts administered by SUNAT, which constitute treasury revenues, is approved in order to facilitate the payment of tax debts.

Tax debts that are payable up to the filing date of the foster care application may be included in the regime, including among others, (i) payments on account for corporate income tax for the periods January, February and March 2020; (ii) debts for fines; and (iii) the balances of previous deferrals and/or installments that are pending payment, without prejudice to the state in which they are found. The term of deferment does not extend after 31 December 2020. This will not apply in the case where the taxpayer did not have income in a certain period.

Maximum deferment times:

  • Deferment only: up to 6 months;
  • Postponement and installments: up to 6 months of postponement and up to 30 months installments.
  • Installments only: up to 36 months.

Interest rate

40% of the default interest rate-TIM (The TIM is 1% per month in national currency).

The term to present the application for acceptance to the regime begins on the effective date of the Superintendence Resolution that regulates this Legislative Decree and ends on August 31, 2020. This term may be extended by Supreme Decree.
