On 15 February 2024, Costa Rica’s Ministry of Finance published Resolution No. MH-DGT-RES-0002-2024 of 7 February 2024 in the Official Gazette. This resolution outlines new guidelines for submitting audited financial statements by taxpayers categorized as “Large National Taxpayers” who report a negative tax base (loss) or zero tax liability in a given tax period. Previously, taxpayers only needed to submit audited financial statements upon request from the tax authority.

As per the new regulations, large taxpayers must submit audited financial statements if they report a negative tax base (loss) or zero tax liability without any request. Other large taxpayers still require a request from the tax authority.

Audited financial statements, after being requested for automatic submission, must be provided within three months at the end of a fiscal period. A three-month extension may be possible upon request from the taxpayers.

For the 2023 fiscal period, the deadline is extended for the automatic submission of audited financial statements within three months after the annual tax return deadline. Additionally, for the fiscal period ending on 31 December 2023, the submission deadline is 15 June 2024, taking into account the standard deadline of 15 March 2024.
