Chile’s Internal Revenue Service (SII) has introduced a special procedure allowing sellers of qualifying new homes to reclaim VAT refunded to buyers, with applications opening on 1 December 2026.
Chile’s tax authority, the Internal Revenue Service (SII) announced on 30 October 2026 that it issued Resolution Ex. SII No. 146 of 23 October 2026.
The resolution sets out a special process that allows home sellers to claim back the value added tax (VAT) they already refunded to buyers. The rule rests on the fourth transitional article of Law No. 21,850, the National Reconstruction and Economic and Social Development Law.
The SII says the resolution aims to put the refund process into practice for certain new home sales. It also gives sellers and buyers greater operational certainty about how the process will work.
Who qualifies
The procedure covers new homes sold by public deed from April 2026, when the bill was sent to Congress, up to the first business day of December 2026. That date follows the publication of Law No. 21,850.
The SII checks each sale against its own databases. It confirms five things: that the property is a residential dwelling, that the sale is the first one for that home, that a final occupancy permit exists, the date of the deed, and that the buyer received the VAT refund from the seller.
How sellers apply
Sellers file Form F3298, “Application for VAT Refund, Article 4, Transitional Provision, Law No. 21,850,” on the SII website starting 1 December 2026. Each sale requires a separate application, and sellers have three years from 1 December 2026 to file.
Buyers must also submit Simple Sworn Statement F3299 to confirm they received the refund from the seller who files the claim.
Decision timeline
The SII aims to decide each application within five business days of receiving it. If its records are missing information, the applicant must provide the details to the relevant Regional Directorate. The resolution takes effect on 1 December 2026.
