The draft law regarding the company establishment under the electronic one-stop shop process was submitted to the parliament on 25th November 2016. The draft law covers the following things:
- The company establishment via an electronic one-stop shop procedure;
- The likelihood of drafting articles of association of a limited liability company (Ε.Π.Ε.) and société anonyme (Α.Ε.) without a civil-law notary document being needed. The Economic and Development Ministry is expected to issue a ministerial decree to determine these requirements;
- A 30% discount in respect of incorporation fee, which is normally paid by companies established under the physical one-stop shop process. Also, companies set up under this procedure can be exempt from the incorporation fee for the first year of their operation under certain criteria;
- The owners of the company will not be obliged to get and show a tax compliance certificate at this stage. In accordance with the draft law, this change will decrease the period of the establishment of a company to only one day;
- The taxpayers will get access to the TAXISNET system instantly after the establishment of the company. So, the taxpayers will not have to request access to the TAXISNET system from the local offices of the tax authorities;
- The chance for a general partnership to convert to a limited partnership.
