The European Commission released the Commission Implementing Regulation 2024/2661 in the Official Journal of the European Union (OJEU) on 15 October 2024, which enforces a definitive anti-dumping duty on aluminium radiator imports from China.

The Regulation follows an investigation lodged on 17 October 2023 by the International Association of Aluminium Radiator Manufacturers (“the applicant”) on behalf of the Union industry of aluminium radiators in the sense of Article 5(4) of the basic Regulation. The request for review was based on the grounds that the expiry of the measures would be likely to result in the recurrence of dumping and the recurrence of injury to the Union industry.

The investigation revealed significant state intervention in China’s aluminium radiator sector, distorting production costs and resource allocation. Consequently, the European Commission used undistorted benchmarks to assess the normal value for aluminium radiators and confirmed the ongoing dumping of the radiators.

The dumping practices have adversely impacted the EU industry, leading to diminished sales, profit losses, and a decline in market share. The European Commission determined that without imposing duties, these dumped imports would persist in harming the EU industry.

The investigation of continuation or recurrence of dumping covered the period from 1 January 2023 to 31 December 2023. The examination of trends relevant for the assessment of the likelihood of a continuation or recurrence of injury covered the period from 1 January 2020 to the end of the review investigation period.

The anti-dumping duties currently in force are at rates ranging between 12.6% and 56.2% on imports from the sampled exporting producers, 21.2% on the non-sampled cooperating companies and 61.4% on all other companies in China.

The Regulation became effective on 16 October 2024 and applies to all EU Member States.
