The Supreme Administrative Court of the Czech Republic has issued a decision in a case regarding a company that took tax relief on the basis of some investment incentives and was needed to establish arm’s length prices due to its transaction with related parties. The decision highlighted on the rules of burden-of-proof in such cases when investment incentives are incorporated. According to the court, the taxpayer in this case had unsuccessful to validate any economic link between the individual activities.
