Colombia’s Constitutional Court has provisionally halted Decree 1390 of 2025, which declared a state of economic and social emergency, and blocked the related tax measures under Decree 1474 of 2025, pending a final ruling on their constitutionality.

Colombia’s Constitutional Court announced the provisional suspension of Decree No. 1390 of 22 December 2025 on 29 January 2026, which declared a state of economic and social emergency across the national territory. The suspension will remain in effect until the full court issues a substantive ruling on the decree’s constitutionality.

As a direct consequence, Legislative Decree No. 1474 of 29 December 2025, which introduced tax measures intended to fund expenses arising from the emergency, will not take effect until the court reaches a final decision.

The provisional rulings were issued under Orders 082 and 084 of 2026, with Case Files RE-387 and RE-388 presiding.

The decisions were supported by a majority of magistrates, while Héctor Alfonso Carvajal Londoño and Vladimir Fernández Andrade dissented. Magistrates Juan Carlos Cortés González and Natalia Ángel Cabo issued clarifications on their votes.

Vice President of the Constitutional Court, Paola Andrea Meneses Mosquera, confirmed that the suspension applies nationwide and remains in force until the court delivers its definitive ruling.

The suspended measures had been introduced to provide the government with emergency economic powers and additional revenue to manage the crisis outlined in Decree 1390, but their constitutionality is now under judicial review.
