The Law containing tax and financial measures and measures regarding sustainable development was published on 28 June 2013 in the Belgian Official Gazette.
Resident companies and permanent establishments are currently able to deduct 80% of R&D expenses. For R&D, the percentage of the exemption from payment of wage withholding tax has been increased from 75% to 80% and this is applicable to the wage withholding tax due as from 1st July 2013.
The notional interest deduction (NID) rate for assessment year 2014 will be 2.742% and it is now being calculated on the basis of the average return of the 10-year government bond in the months July, August and September preceding the tax year. The absolute limit of 3% remains in place.
For taxpayers subject to corporate income tax, legal entities income tax and non-resident (corporate) income tax, the filing of an electronic return through BIZTAX will become mandatory as from assessment year 2015 (but the date of introduction can be advanced by Royal Decree).
