The Argentine tax authority (AFIP), in a release, on 15 August 2024, provided clarification about the “My Facilities” system, which taxpayers must utilise to participate in the regularisation regime for tax, customs, and social security obligations introduced by the Law of Palliative and Relevant Fiscal Measures (Ley de Medidas Fiscales Paliativas y Relevantes), referred to the Law 27743.

The release notes specify the deadlines for obtaining various levels of relief under the regime. This includes the forgiveness of a percentage of accrued compensatory and punitive interest, which is contingent on how promptly a taxpayer complies with the regime and adheres to the payment terms.

The current moratorium is intended for taxpayers and those responsible for tax, customs and social security obligations whose application, collection and inspection are the responsibility of the AFIP.

Taxpayers can take advantage of this for obligations due by 31 March, 2024, as well as for fines and penalties resulting from violations committed up until that date. This includes not only those related to the aforementioned obligations but also any compensatory and punitive interest.

The percentage of interest forgiveness is determined according to the chosen payment method and the date on which the adhesion occurs with respect to the date of entry into force of the regulations of Law No. 27,743.

Payment in cash or through instalment plans of up to three instalments, included in sections a), b), c), d), e) of article 6 of law 27,743:

  • 70% forgiveness by signing up until 15 August, 2024;
  • 60% forgiveness by signing up between 16 August, 2024 and 14 September, 2024;
  • 50% forgiveness by signing up between 15 September, 2024 and 14 October, 2024;
  • 40% forgiveness by signing up until 14 October, 2024;
  • 20% forgiveness by signing up between 15 October, 2024 and 13 December, 2024.

Regularisation of payment facility plans in force as of 31 March, 2024:

  • 30% forgiveness of compensatory and punitive interest accrued to the original consolidation date.

Compensatory and punitive interest owed for tax obligations cancelled before 31 March, 2024,  inclusive:

  • 100% forgiveness.
