Australia’s House of Representatives has approved the Future Made in Australia (Production Tax Credits and Other Measures) Bill 2024 on 11 February 2025.
Earlier, the bill was passed by the Senate, meaning the legislation has passed both houses of Parliament.
The legislation proposes refundable tax offsets to support hydrogen and critical minerals production while enabling Indigenous Business Australia to invest in First Nations communities and enterprises.
The legislation introduced the Critical Minerals Production Tax Incentive (CMPTI) and Hydrogen Production Tax Incentive (HPTI), announced in the 2024-25 Budget.
The HPTI offers a refundable tax credit of AUD 2 per kilogram of eligible hydrogen produced. The CMPTI provides a refundable tax credit of 10% of eligible production costs for specified critical minerals.
Both incentives are available from 1 July 2027 to 30 June 2040 for a maximum of 10 years per project.
