Colorado

The Colorado House of Representatives and the Colorado Senate have passed House Bill 24-1134; this legislation intends to repeal the existing “three out of six test” for combination.

As per this test, the combined group comprises members from an affiliated group of C corporations, provided they meet at least three out of six specified criteria during the tax year and the two preceding years.

It is also to be noted that Colorado does not enforce worldwide combined reporting.
